3. Account registration
- You must provide accurate and complete information when creating your Account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your Account.
- You must notify us promptly at admin@bookable.online if you suspect unauthorised access to your Account.
4. Free trial
We may offer a free trial period. During the trial you have access to Platform features as described at the time of sign-up. We reserve the right to modify or discontinue trial offerings at any time. No payment is required during the trial. If you do not subscribe to a paid plan before the trial ends, your access to paid features will be suspended, but your data will be retained for 30 days.
5. Subscriptions and payment
- Paid subscriptions are billed monthly in advance at the rate displayed on our pricing page at the time of purchase.
- All prices are in GBP and exclusive of VAT unless otherwise stated.
- Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
- We may change pricing with 30 days' written notice. Continued use after the price change takes effect constitutes acceptance.
- Failed payments may result in suspension of access until the outstanding balance is settled.
6. Cancellation and refunds
- You may cancel your subscription at any time from your account settings or by contacting admin@bookable.online.
- Cancellation takes effect at the end of the current billing period. You retain access until then.
- We do not provide pro-rata refunds for partial billing periods.
- After cancellation, your Client Data will be retained for 30 days. After that period, it will be permanently deleted unless you request an export.
7. Your data
- You retain full ownership of your Client Data. We do not claim any intellectual property rights over it.
- You grant us a limited licence to host, process, and transmit your Client Data solely to provide the Platform and its features.
- You are responsible for the lawfulness of any personal data you upload or sync to the Platform. Where you store your own clients' personal data, you act as the data controller and we act as your data processor.
- You may export your data at any time using the export features available within the Platform.
- Our handling of personal data is described in our Privacy Policy.
8. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Upload or transmit malicious code, viruses, or any material that could damage or disrupt the Platform
- Attempt to gain unauthorised access to any part of the Platform, other accounts, or connected systems
- Use the Platform to send unsolicited bulk communications (spam)
- Resell, sublicence, or redistribute access to the Platform without our written consent
- Reverse-engineer, decompile, or attempt to extract the source code of the Platform
- Exceed reasonable usage limits in a way that degrades performance for other users
We reserve the right to suspend or terminate any Account that violates these terms, with or without notice depending on the severity of the violation.
9. Third-party integrations
- The Platform allows you to connect Third-Party Services such as Google Calendar, Microsoft Outlook, Stripe, Squarespace, and others.
- When you connect a Third-Party Service, you authorise us to access and sync data between that service and the Platform in accordance with the permissions you grant.
- We are not responsible for the availability, accuracy, or conduct of any Third-Party Service. Your use of each Third-Party Service is subject to that provider's own terms and privacy policy.
- You may disconnect any Third-Party Service at any time from your account settings.
10. AI features
The Platform may include AI-powered features such as automated insights, natural-language queries, and workflow suggestions. These features are provided as tools to assist your decision-making. We do not guarantee the accuracy or completeness of AI-generated outputs and you remain responsible for any actions taken based on them.
Your Client Data may be processed by AI models to provide these features. We do not use your Client Data to train general-purpose AI models.
11. Intellectual property
- The Platform, including its design, code, branding, and documentation, is the intellectual property of Bookable Ltd.
- Your subscription grants you a non-exclusive, non-transferable, revocable licence to use the Platform for your internal business purposes.
- Nothing in these Terms transfers any ownership of our intellectual property to you.
12. Availability and support
- We aim to keep the Platform available at all times but do not guarantee uninterrupted access. Downtime may occur for maintenance, updates, or reasons beyond our control.
- We provide support via email at admin@bookable.online. Response times depend on your subscription tier.
- We are not liable for any loss or damage arising from scheduled or unscheduled downtime.
13. Limitation of liability
- The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- To the maximum extent permitted by law, Bookable Ltd's total liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the total fees you paid to us in the 12 months preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless Bookable Ltd, its directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your Client Data, your violation of these Terms, or your violation of any law or third-party rights.
15. Suspension and termination
- We may suspend or terminate your Account immediately if you breach these Terms, fail to pay fees when due, or if required to do so by law.
- On termination, your right to use the Platform ceases immediately. We will retain your Client Data for 30 days, after which it will be permanently deleted.
- Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will survive.
16. Changes to these Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
17. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bookable Ltd in relation to the Platform and supersede all prior agreements and understandings.
